Michelle Castle, a member of 13th Floor St James Hall has co-authored an article that was published recently in the LSJ. The article, entitled ‘Taking security for legal costs: lessons from Malouf v Constantinou’, looks at the issue of solicitors taking security from their clients for costs. The recent decision of Parker J in Malouf v Constantinou [2017] NSWSC 923 is considered and some prudent steps are suggested for those solicitors seeking to enter into security arrangements.
